Terms of Service
Last updated: October 16, 2026
Thanks for using Roam Community! These Terms of Service ("Terms") are the agreement between you and Roam Community LLC. We've tried to write them in plain English. Because we can't know every one of our members personally, we need some ground rules, and this is where they live.
Please read the whole thing, but if you only read one part, read Section 2, Outdoor safety and data accuracy. For a map people take into the backcountry, that matters more than anything else here.
The short version#
This summary is here to help you find your way around. It doesn't replace the full Terms below.
- Roam Community is a planning aid, not a safety device. Weather, smoke, snow, alerts, cell coverage, rivers, tides, availability and trail routes can be wrong, late or missing. Don't rely on Roam Community to navigate or to warn you of danger. In an emergency, call 911 and follow officials. (Section 2)
- To create an account, you must be 18 or older and old enough to form a binding contract where you live. You sign in with Apple or Google. (Section 3)
- Premium costs $35.99 per year and renews automatically until you cancel. You can buy it on the web or, through Apple's App Store, in our iPhone app. Cancel any time. Ask within 30 days of your first charge, or of a renewal you didn't want, for a full refund; Apple handles refunds for App Store purchases. (Section 5 and our Refund & Cancellation Policy)
- Roam Community doesn't book or sell campsites, and the prices we show are estimates. (Section 6)
- You own what you contribute, and you let us use it in the Service. We review every contribution before it appears on the map. If you delete your account, your contributions stay on the map, no longer linked to you. (Section 8)
- Don't scrape, resell, break or abuse the Service, or try to work out who made a contribution. (Section 9)
- Our liability is limited as far as the law allows. (Sections 13 to 15)
- Disputes go to the state courts in Lebanon County, Pennsylvania, the federal court for the Middle District of Pennsylvania, or small-claims court. There's no forced arbitration and no class-action waiver. (Section 16)
1. Who we are and accepting these Terms#
Short version: These Terms are a contract between you and Roam Community LLC. Using Roam Community means you agree to them.
"Roam Community," "we," "us" and "our" mean Roam Community LLC, a Pennsylvania limited liability company. We're a small, two-person company based in Annville, Pennsylvania.
The "Service" means Roam Community: the website at https://roam.community, the web app at https://roam.community/app, our iOS and Android apps (coming soon), and the maps, data and features we provide through them. "You" means the person using the Service.
By signing in to or using the Service, you agree to these Terms, which include our Refund & Cancellation Policy. Our Privacy Policy explains how we handle your information. If you don't agree, please don't use the Service. If you buy Premium, before you're charged we'll show you the automatic-renewal terms described in Section 5 and ask you to agree to them.
The current version of these Terms applies. Section 17 explains how and when changes take effect.
2. Outdoor safety and data accuracy#
Please read this section carefully. Roam Community helps you plan. It is not a navigation device, not an emergency alert service, and not a substitute for your own judgment. The information in it can be wrong, out of date or missing, and outdoors that can be dangerous.
The information is for general guidance only#
Much of what you see in Roam Community is modelled, estimated, predicted or delayed. It comes from government agencies, companies, open-data projects and other members, and we combine and process it ourselves. Any of it may be inaccurate, incomplete, out of date, shown in the wrong place, or missing entirely. We work hard on it, but we can't verify it all and we don't guarantee it.
In particular:
- Weather, wildfire smoke and snow depth are model forecasts and estimates. Forecasts are often wrong, especially in the mountains and remote areas, and conditions can change fast. Climate averages describe past years, not what will happen on your trip.
- Alerts (National Weather Service watches and warnings, wildfire perimeters and incidents, and National Park Service closures and danger notices) are checked every few minutes. They are not live. They can be delayed, incomplete or missing. We sort them into our own categories, and some park alerts are pinned to the middle of the park instead of the place they describe. Our alerts are not official National Weather Service products.
- Cell coverage and signal maps are modelled from the coverage carriers report to the Federal Communications Commission (FCC). They are not measurements of real-world reception. You may have no signal where the map shows coverage. Never count on the map to tell you whether you'll be able to call for help.
- Rivers show stream-gauge readings and National Weather Service flood stages. Gauges fail, readings lag, and water can rise quickly, especially in a flash flood.
- Tides and tidal currents are NOAA predictions, not observations. Wind, weather and local conditions can make real water levels and currents very different. Tides and currents are not for navigation.
- Slope and grade, tree cover, light pollution and noise are estimates from elevation data, satellite data, models and member scans. They can be wrong or out of date. Check a site yourself before you set up.
- Campsite availability is refreshed about every 15 minutes and may already be out of date. Only the booking site can tell you whether a site is really available (see Section 6).
- Trail routes are generated automatically from map data, including OpenStreetMap, using Mapbox's walking directions. A route may follow a trail that is closed, washed out, overgrown, seasonal, unsafe, on private land or off-limits to you. We flag some restricted trails, but those flags come from map tags that are often incomplete: no flag does not mean a trail is open or legal for you to use. Off-route alerts can fail or be wrong because of GPS error, lost signal, a dead battery or your phone's settings.
- Offline maps don't change until you download them again, and they won't show new alerts or availability.
- Member contributions such as campsite pins and scans come from other people. We review them before they appear, but we don't verify them. Foliage reports aren't shown individually; they go into improving the fall-color map.
Not for navigation#
Roam Community's maps, routes and cues are aids for planning and general orientation. They must not be your only way of finding your way. Don't use the Service for any purpose that requires precise direction, distance or location. Carry a map and compass and know how to use them, check official trail and road information, obey posted signs and closures, and turn back when conditions call for it. Never use Roam Community for marine, aviation or any other navigation where a mistake could put someone at risk.
Not an emergency service#
Roam Community is not an emergency alert service. We don't watch your location for danger, and we can't tell if you're in trouble or call for help for you. In an emergency, call 911.
Always follow instructions from emergency officials, land managers and rangers, including evacuation orders, fire restrictions and closures. Pay attention to official emergency alerts on your phone, radio and local news, and to posted signs, even if Roam Community shows something different or shows nothing at all.
You're responsible for your own safety#
Camping, hiking, driving remote roads, and spending time near rivers, coasts, wildfire, snow and wildlife are inherently risky. You can be injured, get lost or stranded, or worse, even if you do everything right. You choose where you go and what you do, and you're responsible for your own safety and for the safety of anyone with you.
Before you go, check current conditions with official sources, tell someone your plans, and bring what you need to get yourself out of trouble. Where signal is unreliable, consider a satellite messenger or personal locator beacon.
A place appearing on our map doesn't mean you're allowed to be there or that it's safe. Respect land rules, private property, permits and closures.
Don't let Roam Community distract you while driving. Set up your route before you leave, and let a passenger handle the phone.
To the fullest extent the law allows, you use the Service and its information at your own risk. Sections 13 and 14 explain the limits on our responsibility.
3. Eligibility and your account#
Short version: You need to be 18 or older and sign in with Apple or Google. Keep your account secure.
Age#
To create an account, you must be 18 or older and old enough to form a binding contract where you live. If we learn that someone under 18 has an account, we'll close it, delete its information, remove its Contributions from the map, cancel any subscription and refund the latest charge in full. We keep only the purchase records the law requires.
Where the Service works#
The Service is designed for the United States, and most of our data covers only the US. You may not use the Service if US law prohibits you from doing so, including if you're on a US government sanctions or restricted-party list.
Signing in with Apple or Google#
You sign in to Roam Community with an Apple account ("Continue with Apple") or a Google account ("Continue with Google"). We don't currently offer any other way to sign in. The web app and our phone apps can't be used without signing in. Apple's own terms govern your Apple account, and Google's own terms govern your Google account. We receive some basic information from Apple or Google when you sign in, as described in our Privacy Policy.
If you sign in with Apple and Google using the same email address, the two are linked to one Roam Community account, but only after you've signed in with the one you used first.
One person, one account#
Each account is for one person. Don't share your account, and don't create extra accounts to get around a free-trial limit or a suspension. Accounts created by bots or other automated methods aren't allowed.
Keeping your account secure#
You're responsible for activity under your account and for keeping it secure. In practice, that mostly means keeping your Apple or Google account secure (we recommend two-factor authentication, which Google calls 2-Step Verification) and signing out on shared devices. We aren't responsible for losses caused by a failure to keep your account secure. If you think someone has used your account without your permission, email support@roam.community right away.
4. The Service: Free and Premium#
Short version: Much of Roam Community is free. Premium adds more layers and tools. Features will change over time.
What Roam Community does#
Roam Community is a map for camping and road trips. It shows campgrounds and campsites with availability, and map layers such as cell coverage, terrain, forecasts, climate averages and alerts. It also has a trail route planner, offline maps, saved stays and routes, and ways to send us feedback.
Free features#
As of the date at the top of these Terms, free members get:
- campground and campsite information, including availability;
- alerts;
- tree cover;
- terrain grade (slope);
- cell coverage as reported by carriers to the FCC;
- timed layers at the present: the current hour's forecast, this month's climate averages and this week's fall color; and
- fall foliage from September through November, going by your device's date, with some leeway at each end. We may change this window.
Premium features#
Premium adds:
- carrier signal heat maps (modelled, not measured; see Section 2);
- rivers (gauge flow and height);
- tides and tidal currents;
- human noise and light pollution;
- snow depth;
- campground filters (open dates, site and rig, amenities, dark skies, quiet, cell service and weather);
- trail routes: planning a hike, and following it with off-route alerts;
- offline maps: downloading an area to use without signal;
- any time other than now on timed layers: other forecast hours, other months' climate averages and other weeks of fall color; and
- fall foliage outside its free season.
Features change#
Roam Community is a small, evolving product. We regularly add, change and remove features and data sources, and we may move a feature between Free and Premium. Some features, such as contributions, are in testing and only available to some members. Test features can be less reliable and may change or disappear. We may also limit, pause or stop the Service or any part of it, temporarily or permanently.
If a change significantly reduces what Premium includes during a period you've already paid for, contact us and we'll consider a refund under our Refund & Cancellation Policy. If we stop offering Premium entirely, see Section 12.
Features and bugs#
We design Roam Community with care, based on our own trips and on feedback from members. But no service pleases everybody, and we can't promise it will meet your particular needs. Like all software, the Service has bugs. We fix what we can, prioritizing as we see fit, but not every bug will be fixed, and we don't promise the Service will be error-free or always available.
5. Premium subscriptions and payment#
Short version: Premium costs $35.99 per year and renews until you cancel. Buy it on the web or in our iPhone app. Cancel any time. Recent web charges can be refunded in full; Apple handles App Store refunds.
Price and checkout#
Premium costs $35.99 per year, billed annually. On the web, in the US and Canada, sales tax may be added at checkout where it applies; elsewhere, the price shown includes VAT or similar taxes. Outside the US, the App Store shows a local price, set by Apple's price tiers.
Premium is sold in two places: on the web, through RevenueCat's checkout, with Stripe processing the payments; and in our iPhone app, as an in-app purchase through Apple's App Store, where Apple bills you. The terms and privacy policies of RevenueCat and Stripe, or of Apple, also apply to the payment.
Automatic renewal#
Premium renews automatically every year until you cancel. Each year, you'll be charged $35.99, plus any tax that applies, to the payment method you gave at checkout. By subscribing, you authorize us, through our payment processor, to make these yearly charges until you cancel. If you bought Premium in the App Store, Apple makes these yearly charges instead, at the App Store price, to the payment method on your Apple Account.
Free trials#
If you've never made a purchase from us on your account, Premium starts with a 7-day free trial. A trial you started counts, even if you cancelled it. We may refuse a trial if we think someone is creating accounts to get repeated trials. In the App Store, Apple decides who gets the trial, for each Apple Account.
Unless you cancel before the trial ends, your paid subscription starts automatically when it ends, and you'll be charged $35.99 per year (or the App Store's local price), billed annually, until you cancel. If you cancel during the trial, you won't be charged, and you keep Premium until the trial ends.
What we'll show you and send you#
Before you're charged, we show you the price, the billing interval, any free trial, that Premium renews automatically until you cancel and how to cancel, and ask you to agree. The app shows the same terms next to every Premium offer.
For web purchases, RevenueCat, our billing provider, sends receipts and other billing emails on our behalf, and before each yearly renewal, we'll email you a reminder with the price, the renewal date and how to cancel. For App Store purchases, Apple sends the receipts.
Price changes#
If we change Premium's price, it applies to new subscriptions; your subscription keeps the price you signed up at. If your subscription ends and you subscribe again later, the price at that time applies. If we ever need to change the price of an existing subscription, we'll email you before the new price applies, as the law requires (in California, 7 to 30 days ahead), and you can cancel.
Failed payments#
If a renewal payment on the web fails, we'll keep trying to collect it for up to 30 days. You may keep Premium during a short grace period. After that Premium switches off, but if a later attempt succeeds you'll be charged, Premium comes back, and your billing date moves to that day. To stop the attempts, use Cancel Premium, the link in the payment-problem email, or email us. For App Store purchases, Apple handles failed payments under its terms.
How to cancel#
You can cancel Premium at any time. You don't need to give a reason, and we won't make you talk to anyone or sit through offers to stay. If you bought it on the web, you can cancel:
- in the app: open Account, then Manage account, and tap Cancel Premium under Your plan. It opens our billing provider's customer portal, where you confirm;
- from a billing email: use the customer-portal link in a receipt or payment-problem email; or
- by email: ask us at support@roam.community. The account holder, or the person who paid (as shown on the receipt), can ask.
If you bought it in our iPhone app, Apple bills you, so cancel it in your Apple Account's Subscriptions settings: on iPhone, open Settings, tap your name, then Subscriptions. Or, in the app, open Account, then Manage account, and tap Manage in the App Store. Cancelling on the web or by email doesn't cancel an App Store subscription.
During a free trial on the web, cancel with Cancel Premium or by email. Cancelling stops future renewals. You keep Premium until the end of the year you've already paid for (or the end of your free trial), and then your account switches back to the free features. Deleting the app doesn't cancel your subscription, and deleting your Roam Community account doesn't cancel an App Store subscription. Our Refund & Cancellation Policy has step-by-step instructions.
Refunds#
For Premium bought on the web:
- First purchase: if you ask within 30 days of your first Premium charge (including the first charge after a free trial), we'll refund it in full.
- Renewals: if a yearly renewal goes through that you didn't want, ask within 30 days of that renewal charge and we'll refund it in full.
- Everything else: email us and we'll look at it case by case.
To ask, email support@roam.community. You don't need to give a reason, and we won't check how much you've used Roam Community.
Refunds are always for a whole payment, never partial or prorated. Refunding your latest charge ends your subscription and your Premium right away; refunding an older charge doesn't. Refunds go back to your original payment method. If that doesn't work, we'll contact you and pay it another way. EU and UK residents also have a 14-day right to withdraw, explained with the other details in our Refund & Cancellation Policy.
For Premium bought through Apple's App Store, refunds are Apple's decision: ask Apple at reportaproblem.apple.com. We can't issue them, so wherever these Terms say we'll refund a charge, that applies only to charges made on the web.
Premium on the web and in our mobile apps#
Premium belongs to your Roam Community account, not to a device, whichever way you bought it. It works on the web and in our iOS and Android apps (once they're available) when you sign in to the same Roam Community account. If you bought Premium in the App Store, Restore Purchases in the app ties your Apple Account's purchase to the Roam Community account you're signed in to. After you subscribe, cancel or get a refund, it can take up to about an hour for the change to show in the app.
Purchases through Apple's App Store or Google Play#
Premium is sold on the web and, through Apple's App Store, in our iPhone app. If you buy it in the App Store, Apple bills you under its terms, you cancel in your Apple Account's Subscriptions settings, and Apple's refund process applies, as our Refund & Cancellation Policy explains. We don't sell Premium through Google Play yet. If we do, Google Play will bill you under its terms, you'll cancel in its settings, and its refund process will apply.
6. Campsite availability, prices and bookings#
Short version: We help you find campsites. We don't book or sell them.
Roam Community doesn't book, sell or reserve campsites, and we aren't a travel agent or booking agent. When you book, you book directly with someone else, such as Recreation.gov, a state park system or a private campground, under their terms, fees, rules and cancellation policies. We aren't part of that booking and aren't responsible for it, including cancellations, overbooking, refunds or the condition of the site.
Availability comes from third parties, including Campflare and Recreation.gov, and is refreshed about every 15 minutes. A site shown as available may already be taken, and the reverse.
Prices are estimates. A price shown in Roam Community is generally the published nightly rate multiplied by the number of nights. It may leave out reservation fees, taxes, extra-vehicle or extra-person fees and discounts, and the operator may charge a different amount. The price on the booking site is the one that counts.
Campground details such as amenities, site sizes, rig limits, rules and seasons can be wrong or out of date. Check with the operator before you rely on them.
7. Third-party services and data#
Short version: Roam Community is built on other people's services and data. Their terms apply too, and we don't endorse them (or they us).
The Service relies on third parties, including:
- Mapbox: base maps, satellite imagery, terrain, search, walking directions and offline maps. Mapbox's terms apply to your use of its maps.
- OpenStreetMap: map data © OpenStreetMap contributors. The parts of our campground data that come from OpenStreetMap are available under the Open Database License; email us to request them.
- Government data: from agencies including NOAA and the National Weather Service, the US Geological Survey, the National Park Service, the FCC, NASA and the National Interagency Fire Center.
- Other datasets: for example tree-canopy, land-cover and seasonal-plant data, used under their own licenses (many are CC BY 4.0).
- Campflare: campsite availability, under license.
- Apple: sign-in, and Premium bought in our iPhone app through the App Store, under Apple's terms.
- Google: sign-in, under Google's Terms of Service.
- RevenueCat and Stripe: checkout, billing emails and payment processing on the web. RevenueCat also keeps track of App Store purchases.
Credits and licenses for each map layer's data are shown in the app. Where a third party's terms apply to your use of its service or data, you agree to follow them.
We don't control third-party services or data and aren't responsible for them, including their accuracy, their availability, or what they do with information you give them directly. Using or mentioning a third party doesn't mean we endorse it, and Roam Community isn't affiliated with or endorsed by any government agency or other data provider. Third parties can change or stop providing their data or services at any time, which may affect the Service.
8. Your contributions#
Short version: You own what you contribute and let us use it for the map. We review every contribution before it appears. Once it's on the map, it stays, unlinked from you, even if you delete your account.
What counts as a contribution#
The Service lets you send us campsite pins, campsite traces and outlines, campsite scans (with or without LiDAR), sky scans and fall foliage reports (together, "Contributions"). Feedback reports and survey answers aren't Contributions; Section 10 covers them.
Before your first Contribution, the app explains what it sends us (the precise location and what you measured, linked to your account), that once approved it shows on everyone's map at the spot where you were, and what happens to it, and asks you to tap "I agree." You can't contribute until you do. To withdraw your agreement, tap Withdraw my agreement in the contribute panel. That removes your account from your Contributions, deletes any still waiting for review or that we declined, and clears any your phone hasn't sent.
You own your Contributions#
You keep ownership of your Contributions. We don't claim ownership of them.
The license you give us#
To run the Service, we need your permission to use your Contributions. So you grant Roam Community LLC a worldwide, non-exclusive, royalty-free, perpetual and irrevocable license to host, store, copy, process, analyze, adapt and combine your Contributions with other data; to create data derived from them (for example campsite measurements, slope, tree-cover and foliage estimates); and to display and distribute your Contributions and that derived data, in and in connection with operating, improving and promoting the Service. You also allow our service providers to do these things on our behalf. This license is subject to your rights under our Privacy Policy and applicable law.
You won't be paid for this, and you agree we don't have to credit you by name. The license continues if you stop using the Service or delete your account, because once a Contribution is part of the map and the data built from it, we can't always separate it back out.
We review Contributions before they appear#
We review every Contribution that's shown on the map before it appears there, and we may decline any of them. Foliage reports aren't shown individually and don't go through this review; they're used to improve the fall-color map. Reviewing a Contribution doesn't mean we've verified it.
Other members never see who made a Contribution, and our rules don't allow them to try to find out (Section 9). But they do see exactly where it was made, so think before contributing from a place you don't want others to know about.
Contributions stay on the map#
Other members rely on what's on the map, so once a Contribution is on it, it can't be removed at your request, except where the law requires it or the account belonged to someone under 18 (Section 3). That covers sky scans (tree coverage), campsite scans, campsite locations, campsite grade and foliage reports.
When you delete your data or your account (Section 12), we delete your Contributions that are still waiting for review or that we declined, and remove your account from the rest. They're all marked with the same "deleted" value, so they're no longer linked to your account and can't be grouped by account once backup copies expire (about 30 days). They keep their location and only the day they were made, not the time. We keep them in de-identified form and won't try to re-identify them.
We may still remove a Contribution ourselves, for example if it's wrong or breaks these Terms, and we don't have to keep or display any Contribution.
Rules for Contributions#
You're responsible for your Contributions. When you contribute, you promise that:
- it's your own work, and you have the right to give us the license above;
- it's honest and accurate as far as you know (no fake pins, scans or reports);
- it doesn't include other people's personal information, or reveal private homes or property without permission;
- it isn't illegal, harassing, hateful, sexually explicit, spam or advertising; and
- it doesn't infringe anyone else's rights.
Don't trespass, break land rules, or put yourself or anyone else at risk to collect a Contribution.
9. Acceptable use#
Short version: Use Roam Community for your own trips. Don't scrape it, resell it, break it or abuse anyone.
You may use the Service only for lawful, personal, non-commercial purposes and in line with these Terms. You agree not to:
- Scrape, crawl or bulk-download the map, map tiles, imagery, availability, routes or any other data, whether with bots, scripts or by hand, or access the Service in any way other than through our apps and website as we provide them.
- Copy, redistribute, sell, resell, sublicense or commercially exploit the Service, its data or access to it, including using our data to build or train a competing map, dataset or machine-learning model.
- Reverse engineer, decompile or disassemble the Service, or try to extract its source code or underlying datasets, except where the law expressly allows it despite this restriction.
- Get around Premium, free-trial limits, rate limits or any security or access control, for example by creating extra accounts or tampering with the app.
- Interfere with or disrupt the Service, our servers or our providers, for example by overloading them, probing for vulnerabilities without permission, or uploading malware.
- Use offline maps or other downloads for anything other than your own personal use in the app, or in a way that breaks our map providers' terms.
- Submit false or misleading Contributions or feedback, or try to manipulate what the map shows.
- Try to find out who made a Contribution, or re-identify any de-identified or aggregated information in the Service.
- Harass, threaten or abuse other members or our team. Abusing or threatening our team will get your account closed.
- Impersonate anyone, or misrepresent your connection with anyone, including us.
- Use the Service to break the law or violate anyone else's rights, or help anyone else do any of these things.
These restrictions don't limit any rights you have under an open-data license that applies to part of our data; see the credits in the app.
If you find a security problem, please tell us at support@roam.community instead of exploiting it.
10. Our intellectual property#
Short version: Roam Community belongs to us. We give you permission to use it for yourself.
The Service, including our software, design, text, the Roam Community name and logos, and the map layers, datasets and measurements we create, belongs to Roam Community LLC or our licensors and is protected by intellectual property laws. Third-party data and services belong to their owners, and some data is available under open licenses (see Section 7). We reserve all rights not expressly granted to you in these Terms.
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable license to use the Service for your own non-commercial purposes. You may not copy or reuse our code or visual design without our written permission. Sharing an occasional screenshot of the map for personal, non-commercial purposes is fine, as long as the map credits stay visible.
Don't use our name or logos in a way that suggests we endorse or are connected with you or your product.
Feedback reports, surveys and ideas#
Feedback reports and survey answers aren't shown to other members; only our team reads them. Personal information in them, such as screenshots and device details, is handled as described in our Privacy Policy.
Suggestions are welcome but never required. If you send us ideas for improving the Service, in a feedback report, a survey answer or any other way ("Feedback"), you give us a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use those ideas for any purpose, including building them into our products, without paying or crediting you. This covers the ideas, not the reports and answers themselves. We don't have to use your Feedback.
11. Copyright complaints#
If you believe something in the Service infringes your copyright, send a notice to our designated agent:
- Designated Copyright Agent, Roam Community LLC
- 605 East Walnut Street, Annville, PA 17003
- (717) 926-5870
- support@roam.community
Your notice must include:
- your name, mailing address, phone number and email address;
- a description of the copyrighted work you believe is being infringed;
- a description of the material you believe infringes it, and where it is in the Service, in enough detail for us to find it;
- a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you're the copyright owner or authorized to act for the owner; and
- your physical or electronic signature.
Before you send a notice, please consider whether the use could be fair use or otherwise permitted. Sending a false or frivolous notice can have legal consequences.
If we remove something you posted because of a copyright notice and you believe that was a mistake, you can send a counter-notice to the same agent with the information required by 17 U.S.C. § 512(g). In appropriate circumstances, we'll close the accounts of repeat infringers.
12. Ending your use, suspension and termination#
Short version: You can stop any time, and delete your data or your account in the app. We can suspend or close accounts that break these Terms, and we'll be fair about it.
You can stop any time#
You can stop using Roam Community and sign out whenever you like. If you have Premium, cancel it as described in Section 5; signing out or deleting the app doesn't cancel it.
Deleting your data or your account#
On the web or in our apps, open Account, then Manage account:
- Delete my data deletes most of what you've saved and sent, including saved stays and routes, feedback reports and screenshots, survey answers, crash reports, usage records, and Contributions still waiting for review or that we declined. Your other Contributions stay on the map, no longer linked to you (Section 8). It doesn't delete your sign-in account, membership record, purchase records or any subscription. If you keep using the Service, new usage records start.
- Delete account does all of that, then deletes your sign-in account and membership record. If you sign in again later, you'll start over as a new account.
While a web subscription or a free trial you haven't cancelled is set to renew, including while we're retrying a failed payment, Delete account won't go ahead until you use Cancel Premium (Section 5). An App Store subscription is different: Delete account warns you that Apple will keep billing you until you cancel it in your Apple Account's Subscriptions settings, and lets you delete your account anyway, which doesn't cancel it. If you've cancelled but have paid time left, deleting your account ends that Premium, and the unused time isn't refunded. A web charge that's still within its 30-day refund window (Section 5) can still be refunded in full; email us, ideally before you delete. If you're ever charged on the web after deleting your account, email us and we'll refund that charge in full.
Our Privacy Policy lists exactly what each button deletes and keeps. If you can't use the app, email support@roam.community and we'll help. If you ask us by email to delete your account, we'll cancel any web subscription first.
We can suspend or close accounts#
We may suspend or close your account, or limit your access to all or part of the Service, if:
- you break these Terms or the law, or we reasonably believe you have;
- your use creates risk or harm for other members, for us, for our providers or for anyone else;
- the law, or a provider we depend on, requires it; or
- we stop offering the Service or part of it.
Where it's reasonable, we'll tell you first and give you a chance to fix the problem. We may act right away for serious or repeated violations, abuse of our team, security threats or legal reasons.
Refunds if we end things#
If you have Premium when we end it or close your account for any reason other than your breaking these Terms or the law, we'll refund your latest Premium charge in full. If we suspend Premium for a reason that isn't your fault, we'll add the lost time at no charge. If we close your account or end your Premium because you broke these Terms or the law, whether to refund is our decision, except where the law requires one. Either way, where we're able to, we'll tell you by email.
What survives#
Anything in these Terms that by its nature should keep applying after your account ends will keep applying. That includes the Section 8 license for Contributions you've already submitted, Sections 2, 10 and 13 to 16, Section 19, and any payments or refunds owed.
13. Disclaimers#
Short version: We provide Roam Community "as is." We can't promise it will always work or always be right.
To the fullest extent the law allows, we provide the Service and all information in it "as is" and "as available," without warranties of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We also disclaim any warranty that the Service or its information will be accurate, complete, current, reliable, uninterrupted, secure or error-free, or that defects will be corrected.
Without limiting that, we don't warrant the accuracy of any weather, smoke, snow, alert, coverage, signal, river, tide, current, terrain, tree-cover, availability, price, route or member-contributed information (see Section 2), and we don't warrant any third-party service or data.
Some states don't allow implied warranties to be disclaimed, so some of these disclaimers may not apply to you. Where the law doesn't let us disclaim a warranty, that warranty is limited to the shortest period the law allows.
14. Limitation of liability#
Short version: If something goes wrong, our responsibility is limited as far as the law allows. Some things can't be limited, and we don't try to.
To the fullest extent the law allows:
- No indirect damages. Roam Community LLC and its owners, employees and agents won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, loss of use or loss of goodwill, or for the costs of trips, bookings or plans that didn't work out, arising out of or relating to these Terms or the Service, even if we were told they were possible.
- A cap on everything else. For all claims combined that arise out of or relate to these Terms or the Service, the most we'll have to pay you is whichever is more: US $50, or what you paid us in the 12 months before the event that led to your claim.
- These limits apply whatever the legal theory (contract, tort including negligence, product liability, statute or anything else), and even if a remedy fails of its essential purpose.
What these limits don't cover. They don't reduce our responsibility for fraud, for harm we cause on purpose or through gross negligence, or for anything else the law says can't be limited or excluded, which in some places includes injury or death that our negligence causes. Some states don't allow certain damages to be excluded or limited, so some of the limits above may not apply to you, and you may have other rights.
15. Indemnity#
Short version: If you misuse Roam Community and someone makes a claim against us because of it, you'll cover our reasonable costs.
To the extent the law allows, you agree to defend, indemnify and hold harmless Roam Community LLC and its owners, employees and agents from claims made by third parties, and from the related losses, liabilities and reasonable costs (including reasonable attorneys' fees), to the extent they arise from:
- your Contributions;
- your breach of these Terms; or
- your violation of the law or of someone else's rights.
This doesn't apply to the extent a claim was caused by our own fault. If a claim comes up, we'll tell you promptly, let you control the defense and settlement (but you may not settle in a way that admits fault for us or doesn't fully release us without our consent), and reasonably cooperate with you at your expense. This section doesn't apply where the law where you live doesn't allow it.
New Jersey. If you live in New Jersey, Sections 14 and 15 apply only as far as New Jersey law permits.
16. Governing law and disputes#
Short version: Pennsylvania law applies. Disputes go to the state courts in Lebanon County, Pennsylvania, the federal court for the Middle District of Pennsylvania, or small-claims court. No forced arbitration, and no class-action waiver.
- Talk to us first. If something's wrong, write to support@roam.community and we'll try to work it out. This isn't required before going to court, but we hope you'll give us the chance.
- Governing law. These Terms, and any dispute between you and us arising out of or relating to these Terms or the Service, are governed by the laws of the Commonwealth of Pennsylvania and applicable US federal law, without regard to conflict-of-law rules.
- Where disputes are heard. Disputes will be brought in the state courts located in Lebanon County, Pennsylvania, or the United States District Court for the Middle District of Pennsylvania, and you and we agree to the personal jurisdiction of those courts.
- Small claims. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction.
- No arbitration, and class actions are allowed. These Terms don't require arbitration, and they don't waive your right to bring or take part in a class action or other representative action.
- Your local rights. Nothing in these Terms takes away rights you have under the consumer-protection laws of the place where you live, including any right those laws give you to bring a claim in your local courts.
17. Changes to these Terms#
Short version: When we change these Terms, we'll post the new version. For material changes, you'll get at least 30 days' notice.
We'll post any new version at https://roam.community/terms and change the "Last updated" date. Small changes, like fixing typos or clarifying wording, take effect when we post them.
For a material change, we'll tell you at least 30 days before it takes effect, by email to the address on your account or with a notice in the Service. The notice can be shorter if a change is needed for legal, safety or security reasons, or if it only adds features. If a change materially affects a paid subscription, we'll email you about it, with how to cancel, before it takes effect. Where the law requires it, such a change takes effect at your next renewal after the notice. Price changes follow Section 5.
A change doesn't apply to disputes that arose before it took effect. If you keep using the Service after a change takes effect, the new version applies to you. If you don't accept a change, you can stop using the Service. If you have Premium and tell us before a material change takes effect that you don't accept it, we'll cancel your subscription and refund your latest charge in full.
18. App stores#
Our iOS and Android apps are coming soon. If you download one of them from Apple's App Store or Google Play, these extra terms apply. If they conflict with the rest of these Terms for an app from that store, these terms win.
- These Terms are between you and Roam Community LLC, not Apple or Google. We, not Apple or Google, are responsible for the app and its content.
- Your license to use the app is limited to devices you own or control, as permitted by the store's usage rules.
- We are solely responsible for maintenance and support of the app. Apple and Google have no obligation to provide any maintenance or support for it.
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app. We, not Apple, are solely responsible for any product warranties that aren't effectively disclaimed, and for any other claims, losses, liabilities, damages, costs or expenses caused by the app's failure to meet a warranty.
- We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the app or your use of it infringes that third party's intellectual property rights.
- You confirm that you aren't located in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you aren't on any US government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the app, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you as a third-party beneficiary.
Questions, complaints or claims about the app go to us, using the contact details in Section 20.
19. General terms#
- Entire agreement. These Terms, including our Refund & Cancellation Policy and the price and automatic-renewal terms you agree to when you buy Premium, are the whole agreement between you and us about the Service, and they replace any earlier agreements about it. If anything shown at checkout conflicts with these Terms, these Terms control, except where the law requires otherwise. If these Terms and the Refund & Cancellation Policy disagree about refunds or cancellation, the Refund & Cancellation Policy controls. Our Privacy Policy explains how we handle your information; it isn't part of these Terms.
- Severability. If any part of these Terms is found unenforceable, that part will be enforced as far as possible in line with its original intent, and the rest of the Terms stay in effect.
- No waiver. There may be times when we don't exercise or enforce a right or part of these Terms. That doesn't mean we've waived it.
- Assignment. You can't transfer these Terms or your account to anyone else without our written consent. We may transfer these Terms as part of a merger, acquisition or sale of all or part of our business or assets, and we'll let you know if that happens.
- Events beyond our control. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers, internet failures, natural disasters or government action.
- Electronic communications. You agree that we may communicate with you electronically, by email to the address on your account or through the Service, and that these communications meet any legal requirement for a written communication. This doesn't affect rights you can't give up.
- Notices to us. Send legal notices to support@roam.community and by mail to Roam Community LLC, 605 East Walnut Street, Annville, PA 17003. We offer support mainly by email.
- Headings and summaries. Headings and "short version" summaries are there to help you read these Terms. If they differ from the full text, the full text controls.
- No other beneficiaries. Except as stated in Section 18, nobody else has rights under these Terms.
- Our relationship. These Terms don't create any partnership, employment, agency or joint venture between you and us.
- California users. Under California Civil Code § 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
